U.S. court rejects Google Book Settlement

A district court in the U.S. state of New York has rejected a settlement was negotiated with the Google of the U.S. Authors Guild and the Association of American Publishers (AAP). The so-called Google Book Settlement is intended to govern how the Internet company may deal with books, although out of print, but are still protected by copyright.

“Although the digitization of books and the creation of a universal digital library has many advantages, the comparison would go too far,” says the verdict. In the opinion of the Court of Google would receive substantial rights of entire books, without permission of copyright holders. Google would get such a significant advantage over competitors. The presiding Judge Denny Chin also described the comparison as “not fair, not fair and not reasonable.”

“This is obviously a disappointment, but we will examine the court’s decision and consider our options,” said Google lawyer Hilary Ware. “Like many others, we believe that the agreement has the potential to provide access to millions of books, which are found in the U.S. today is difficult.”

The publishers were willing to enter into a limited agreement, said John Sargent, CEO of Macmillan, on behalf of the plaintiff. The sentence contains clear directions for necessary changes. He hoped that attached themselves to other parties, a new comparison.

Google began in 2004 with the digitization of books. According to court documents have been scanned since then in collaboration with several universities in more than twelve million books. The legal dispute over protected, but out of print books lasts for six years, the negotiations for a settlement for five years.

NOW LET tilted the comparison was in a class action come the Authors Guild against Google Books about. He made it possible for Google, its contents are out of print books on Book Search display, even if the title is not public domain and there is no authorization for a publisher.

Among the opponents of this scheme include Microsoft, the Electronic Frontier Foundation and the Open Book Alliance. Even the U.S. Justice Department had vigorously criticized the comparison.

2009 Google put pressure on the Justice Department before the redesign now rejected. It regulates the handling of books, which were either registered with the U.S. Copyright Office or published in Great Britain, Australia and Canada. Originally, the comparison should apply worldwide.
